What shapes a Florida land sale.
Land is priced on what can be done with it. These Florida rules come up most often.
Agricultural classification
Greenbelt status stays on the land for the rest of the tax year it sells, but the new owner must file a new application by March 1 to keep it. A high sale price no longer creates a legal presumption against agricultural use; since 2013 the price is just one factor the appraiser may weigh.
Landlocked parcels
Florida recognizes an implied way of necessity when a seller's own conveyance cut a parcel off, and a statutory way of necessity for landlocked land used or meant for homes, agriculture, timber, or stockraising. A court can set the route and compensation when owners cannot agree.
Wetlands and permits
In Tampa Bay, the Southwest Florida Water Management District requires an Environmental Resource Permit before construction that affects wetlands or changes stormwater flow. A formal wetland determination can be binding for up to 5 years if conditions on the land do not change.
Septic and buildability
County health departments still issue septic permits in Tampa Bay under the state DEP program, and a site evaluation checks the soil and other conditions before a system can be approved.
Back taxes and tax certificates
Unpaid taxes on land can be sold as tax certificates. The holder can apply for a tax deed two years after April 1 of the year the certificate was issued, and the owner can redeem until a tax deed is issued.
Surveys and disclosures
Florida law does not generally require a survey to sell vacant land. Land seaward of the coastal construction control line needs a seller disclosure and an affidavit or survey unless the buyer waives it in writing, and lots in a mandatory HOA need the HOA disclosure summary.
What can affect your as-is cash offer.
| Input | How it affects the offerPlain English |
|---|---|
| Access and frontage | Legal road access, easements, and frontage decide how usable the land is. |
| Zoning and land use | Zoning, future land use, and lot size determine what can be built or continued. |
| Wetlands, flood zone, and soils | Wetland lines, the flood zone, and septic suitability affect how much of the land is buildable. |
| Taxes, liens, and owners | Back taxes, tax certificates, liens, and heirs or co-owners are resolved through title before closing. |
How the property and local records can change the sale.
Pinellas County
For Gulf-front land in Pinellas, parcels seaward of the coastal construction control line come with a state disclosure, and the seller provides an affidavit or survey unless the buyer waives it in writing.
Hillsborough County
The Hillsborough County Property Appraiser requires a new greenbelt application after any change of ownership, so an agricultural buyer plans for the March 1 filing date.
Pasco County
Pasco land falls under the Southwest Florida Water Management District, which permits construction that affects wetlands or stormwater, and an owner can petition for a formal wetland determination.
Hernando County
As elsewhere in Tampa Bay, Hernando septic permits come through the county health department after a site evaluation of the soil and conditions on the lot.

Yes. An owner can redeem a tax certificate until a tax deed is issued, and unpaid taxes are typically paid from the sale proceeds at closing.
Florida law does not generally require one. Land seaward of the coastal construction control line needs an affidavit or survey unless the buyer waives it in writing, and buyers often order their own survey.
It stays for the rest of that tax year. The new owner must apply by March 1 to keep agricultural classification for the next year.
Florida's greenbelt statute, s. 193.461, contains no rollback or recapture tax provision. A new owner who wants the classification must reapply.
Yes. Florida law recognizes ways of necessity for some landlocked parcels, and a buyer will price in how legal access can be obtained.
In Tampa Bay counties, Florida's documentary stamp tax on a deed is 70 cents per $100 of the price. Other closing costs depend on the contract, title insurance, and recording.
